Hi. I'm Rick Holman. In case you don’t me, I can give you a very simple introduction. For the people that do know me on twitter, you know that over the past year or so, I have tweeted that I have been on a non-compete agreement for 12 years now. It doesn’t expire and as long as I’m here, then I’ll continue to work knowing that at some point, my company can fire me at any time and I can’t work in my industry for 2 years.
How does that feel? Well, as one of three employment lawyers told me, companies like the one I work for have an attitude that they’re doing me a favor by giving me a job because if they want to fire me at some point, then they can just do that and don’t even have to offer me a severance package.
If one thing is true, management makes sure to let me and others know in their own way that they are doing me a favor by giving me a job. I’ve lived with constant threats for many years and have had interviews with many companies that don’t want to hire me because I don’t have industry related skills. As far as the companies in my industry are concerned, some have met with me and have said in the end that they can’t consider hiring me since they can be sued and even receive a cease and desist letter from my company for hiring me.
In fact, one of the last interviews I had last year was with a company that liked my skills and wanted to consider me until they saw my non-compete. They felt that one of their products competed with the company that I work for. The frustrating part was that my company didn’t hear of this company and this company even admitted that we are not on your radar.
Over the last three years, I have been on a quota now. I have to get 10 accounts a month. If I don't get 10, I have to get 40 in four months or I'm history. It doesn't matter how late I stay. It doesn't matter if I make significant contributions to my company which I do. It doesn't even matter if I go on vacation because the quota still stands. I have a gun to my head and my job is month to month
As a result, I have written three books under the pseudonym, Ron Hummer. The books are The Bachelor Party, A Hell Of A Woman and 96 Rocks. All three books are murder mysteries but also have characters that have been on non-compete agreements.
I can tell you that I'm not alone. Other people in my company have already lost their jobs and are no longer in the industry. If you go on Google News and do a search for non-compete, you'll see other stories like mine as well.
